Client Agreement & Photography Contract
Photoshoot Details
A. Entire Agreement
This agreement contains the entire understanding between ThroughDansLens and the CLIENT. It supersedes all prior discussions and agreements. Any modifications must be made in writing and acknowledged by both parties.
B. Reservation
A signed contract and a 50% non-refundable retainer are required to reserve the photoshoot date and time. If the session is rescheduled, postponed, or canceled by the CLIENT, the retainer is forfeited as liquidated damages. The studio location will be disclosed only after the retainer is received.
C. Photoshoot Schedule
CLIENT must confirm all session details at least 48 hours before the scheduled photoshoot. Any changes in time, location, building access, or group size must be communicated promptly and approved by the photographer.
D. Safety
The photographer reserves the right to terminate the session if unsafe, inappropriate, hostile, or disruptive behavior occurs. All payments remain non-refundable if the session ends due to safety concerns.
E. Shooting Time / Additions
The CLIENT's late arrival does not extend the session. Additional time may be added subject to availability and additional fees.
F. Expenses Incurred
CLIENT is responsible for any location fees, parking fees, or access requirements imposed by the venue or studio.
G. Responsibilities
ThroughDansLens is not responsible for any compromised coverage resulting from late arrival, building restrictions, weather conditions, or lack of access to reserved spaces.
H. Venue Limitations
The photographer shall comply with all studio policies and guidelines. The CLIENT agrees to accept the technical results of any restrictions imposed by the studio.
I. Permits / Access
CLIENT must secure room reservations, event permissions, and, if required, after-hours building access.
J. Copyrights
All photographs remain the copyrighted property of ThroughDansLens. Upon final payment, CLIENT receives a limited personal-use license for personal sharing, social media posting, and personal printing.
K. Model Release
CLIENT grants Photographer permission to use images featuring the CLIENT for portfolio, website, and promotional use unless CLIENT opts out in writing before the session.
L. Limit of Liability
If the Photographer is unable to perform due to illness, an emergency, or circumstances beyond their control, liability is limited to a full refund.
M. No-Show / Late Cancellation
If the CLIENT fails to appear without prior notice, the full session fee is forfeited. Cancellations made less than 24 hours before the session will result in forfeiture of the full retainer. Cancellations made between 24-48 hours before may be rescheduled once at the Photographer's discretion.
N. Force Majeure
Neither party shall be held liable for failure due to circumstances beyond reasonable control. In such cases, the session will be rescheduled at no additional cost, or a full refund will be issued at the Photographer's discretion.
O. Capture & Delivery
The photographer does not guarantee the delivery of every image taken. Final delivered images are selected based on artistic and professional judgment.
P. Post-Production & Editing
Final images will be delivered within 10-14 business days. Editing style and artistic adjustments are at the Photographer's discretion. RAW/unedited files will not be released.
Q. Payment Schedule
50% retainer due at booking. Remaining balance due on or before the photoshoot date. Failure to submit payment may result in cancellation of the session.
